Terms and Conditions for Things 3

These Terms and Conditions (the "Terms") govern your use of Things 3, a Productivity application provided by Cultured Code GmbH & Co. KG ("we", "us", or "our").
By downloading, installing, or using Things 3, you agree to these Terms. If you do not agree, do not use the App.
The app
Things 3 is made available through the Apple App Store. Additional terms from Apple, including the Licensed Application End User License Agreement, may also apply.

License
Subject to these Terms, Cultured Code GmbH & Co. KG grants you a limited, non-exclusive, non-transferable, revocable license to use Things 3 on Apple devices that you own or control, for personal or internal use.
You may not:
- Copy, modify, or create derivative works of Things 3, except as permitted by law.
- Reverse engineer, decompile, or attempt to extract source code, except where that restriction is prohibited.
- Rent, lease, sell, sublicense, or redistribute the App.
- Use Things 3 to violate any law or infringe anyone's rights.
Accounts and content
Some features of Things 3 may require an account. You are responsible for the accuracy of the information you provide and for keeping your credentials secure.
You retain ownership of content you create in Things 3. You grant us a limited license to host, store, and display that content solely to operate the App for you.
You are responsible for the content you store in Things 3 and must not upload unlawful, harmful, or infringing material.
Purchases and subscriptions
Things 3 may be offered for a one-time purchase, as a free download with optional in-app purchases, or with auto-renewing subscriptions billed through Apple. Prices displayed on the App Store, including the current listed price of $9.99, may change.
All billing, refunds, and subscription cancellations for Apple charges are handled by Apple under your Apple ID settings, unless required otherwise by local law.
Privacy
Our collection and use of personal information in connection with Things 3 is described in the Privacy Policy for Things 3. By using the App, you also acknowledge that policy.
Intellectual property
Things 3, including its name, logos, design, and software, is owned by Cultured Code GmbH & Co. KG or its licensors and is protected by intellectual property laws. These Terms do not transfer any ownership rights to you.
Disclaimer of warranties
Things 3 is provided "as is" and "as available". To the maximum extent permitted by law, Cultured Code GmbH & Co. KG disclaims all warranties, whether express, implied, or statutory, including merchantability, fitness for a particular purpose, and non-infringement.
We do not warrant that Things 3 will be uninterrupted, error-free, or free of harmful components.
Limitation of liability
To the maximum extent permitted by law, Cultured Code GmbH & Co. KG and its affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or goodwill, arising from your use of Things 3.
Our total liability for any claim related to Things 3 will not exceed the amount you paid to use the App during the twelve months before the claim, or ten US dollars if you did not pay.
Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.
Termination
You may stop using Things 3 at any time by deleting the App. We may suspend or terminate access to Things 3 if you breach these Terms or if we discontinue the App.
Provisions that by their nature should survive termination (including intellectual property, disclaimers, and limitation of liability) will survive.
Changes to these terms
We may update these Terms from time to time. The updated Terms will be posted at this URL for Things 3. If you continue to use the App after the changes take effect, you accept the revised Terms.
